The African Charter on Human and Peoples' Rights was adopted unanimously in June, 1981, by the Organisation of African Unity (O.A.U.). Although it is not yet in force its adoption represents an important landmark in the protection and promotion of human rights on the African continent. The O.A.U. has in the past been sharply criticized for its apparent indifference to the suppression of human rights in a number of independent African States. Although the founding Charter of the O.A.U. of 1961 makes reference to the issue of human rights in Article II l (e) and also mentions in general terms the need to promote the welfare and well-being of the African people, its primary concern has been with the eradication of colonialism and apartheid on the African continent. In this context it is clearly committed to the achievement of human rights and self-determination of the peoples of South Africa and Namibia. However, other breaches of human rights on a widespread scale, such as the massacre of thousands of the Bahutu tribe of Burundi in 1973, was neither discussed nor condemned by the O.A.U. In 1970, the number of refugees in Africa was estimated at three-quarters of a million; by 1980 it was estimated at five million and is still growing. One in every two of the ten million refugees in the world in 1980 was from Africa and the total number of African refugees now exceeds the population of many African countries. A discussion of the many inter-connected causes of the refugee problem in Africa, the magnitude of which continues to grow, would be beyond the scope of this analysis. However, at the 1981 International Conference on Assistance to Refugees in Africa (ICARA) it was agreed that the African refugee problem required consideration not merely in connection with the need to extend assistance to refugees, but also the need to pay attention to the forces in all their forms, that conspire to generate refugee influxes. In this regard the Conference agreed that besides natural calamities, all refugee situations in Africa are inextricably linked with cases of violations of human and peoples’ rights. Apart from these manifestly political issues, there are of course the humanitarian, social and economic aspects of the problems of refugees which must be dealt with by African States. These non-political aspects alone have created a formidable task for African governments, inter-governmental and non-governmental agencies as well as for the Organization of African Unity (OAU).

The African continent represents a region which faces economic problems of the utmost severity at a time when the global economy itself is ravaged by inflation, unemployment and the effects of a world recession. Africa contains 21 of the world's 45 least-developed nations. Its total Gross National Product accounts for only 2·7 per cent. of the world's Product and Africa has the lowest average per capita income in the world. Many African countries lack basic medical and health care facilities while food shortages and severe unemployment affect a very high proportion of African peoples. Internal African development strategies of the past have been subjected to critical investigation in an attempt to assess the sources of the continent's development problems. Despite its vast natural resources and the praiseworthy efforts of many African governments, the continent as a whole (excluding South Africa) is unable to show any significant economic expansion or growth.
The 1980 Lagos Plan of Action represents the most recent initiative undertaken by the Organisation of African Unity (O.A.U.) in conjunction with the U.N. Economic Commission for Africa (E.C.A.) to develop a successful regional strategy for African development. It aims at economic growth in each individual African state in different sectors including food and agriculture, industry and in environmental and energy matters.
